ATMYNUMBER reserves the right, at its sole discretion, to modify or replace the Terms of Service at any time. If the alterations constitute a material change to the Terms of Service, ATMYNUMBER will notify you by posting an announcement on the ATMYNUMBER Site. What constitutes a “material change” will be determined at ATMYNUMBER’s sole discretion, in good faith and using common sense and reasonable judgment.
You agree and understand that these Terms of Service, the ATMYNUMBER Site and the ATMYNUMBER Services may be modified by ATMYNUMBER at any time without prior notice, and such modifications will be effective upon ATMYNUMBER’s posting of the new terms and/or upon implementation of the new changes on the ATMYNUMBER Site. You agree to review the Terms of Service periodically so that you are aware of any modifications. Your continued use of the ATMYNUMBER Service after any modifications indicates your acceptance of the modified Terms of Service. Unless expressly stated otherwise by ATMYNUMBER, any new features, new services, enhancements or modifications to the ATMYNUMBER Service implemented after your initial access to the ATMYNUMBER Service shall be subject to these Terms of Service.
ELIGIBILITY
You must be a resident of the United States or Canada and must have a valid phone number owned by you. Failure to provide a valid 10 digit phone number can result in deletion or revision of your ATMYNUMBER service.
If your account has been inactive for one or more years, ATMYNUMBER has the right to terminate your account without prior notice.
DESCRIPTION OF SERVICE
Subject to full compliance with the Terms of Service, ATMYNUMBER may offer to provide certain services and content, as described more fully on the ATMYNUMBER Site (“Services”). Services shall include, but not be limited to, any service and content ATMYNUMBER performs for you, as well as the offering of any materials displayed, transmitted or performed on the ATMYNUMBER Site or through the Services.
ATMYNUMBER may change, suspend or discontinue the ATMYNUMBER Services for any reason, at any time, including the availability of any feature or content. ATMYNUMBER may also impose limits on certain features and services or restrict your access to parts or all of the ATMYNUMBER Services without notice or liability.
ATMYNUMBER will forward emails to the designated email address which you provided at the time of registration.
You may create one ATMYNUMBER account for every phone number and/or phone number with extension you own. This includes cell phone numbers, office phone numbers and home phone numbers. If the phone numbers are business numbers, you may create only one ATMYNUMBER account with the permission of the owner of the phone number.
If your phone number changes and the number you have registered with ATMYNUMBER ceases to be a valid phone number, ATMYNUMBER reserves the right to cancel your registration and user account. While ATMYNUMBER will attempt to give you notice of this, ATMYNUMBER is not obliged to do so. ATMYNUMBER welcomes you to create a new account with your new phone number.
ATMYNUMBER will also close your account without notice if the email address you have registered becomes or is invalid..
SPAM
You may not use your ATMYNUMBER account to send SPAM and/or unsolicited commercial email. If you do, we will close your account without notice and reserve the right to take further legal action.
All emails sent to your account will be forward to your chosen email address. We do not keep any copies of emails that are sent.
YOUR REGISTRATION OBLIGATIONS
As a condition to using ATMYNUMBER Services, you are required to register with ATMYNUMBER with a valid e-mail address you own and a phone number you own. You shall provide ATMYNUMBER with accurate, complete, and updated registration information. Failure to do so shall constitute a breach of the Terms of Service, which may result in immediate termination of your ATMYNUMBER account.
You may not: (i) enter, select or use a false name, an email address, a phone number owned or controlled by another person with the intent to impersonate that person, or, (ii) use ATMYNUMBER account subject to any rights of a person other than yourself without appropriate authorization. ATMYNUMBER reserves the right to refuse registration of, or cancel a User ID in its discretion. You shall be responsible for maintaining the confidentiality of your password and are fully responsible for all activities that occur under your ATMYNUMBER account and password. Your ATMYNUMBER account and password provided to you for access to the ATMYNUMBER Service shall be for your personal use only. You agree to (a) immediately notify ATMYNUMBER of any unauthorized use of your ATMYNUMBER account or password, and (b) ensure that you exit from your account at the end of each session.
ATMYNUMBER Services are available only to individuals who are at least 13 years old, whether acting on their own behalf or as an authorized employee or representative of a corporation or other business entity. If you do not so qualify, do not attempt to register for or use the ATMYNUMBER Services.
RESTRICTIONS ON RIGHTS TO USE
As a condition of use, you promise not to use the ATMYNUMBER Services for any purpose that is unlawful or prohibited by these Terms of Service, or any other purpose not reasonably intended by ATMYNUMBER.
- modify, adapt, translate, or reverse engineer any portion of the ATMYNUMBER Site and/or ATMYNUMBER Service;
- use any robot, spider, site search/retrieval application, or other automated device, process or means to access, retrieve or index any portion of the ATMYNUMBER Site and/or ATMYNUMBER Service;
- collect any information about other users or members (including usernames and/or email addresses) for any purpose other than to solicit and share reviews with other ATMYNUMBER users or members;
- reformat or frame any portion of the web pages that are part of the ATMYNUMBER Site and/or ATMYNUMBER Service;
- create user accounts by automated means or under false or fraudulent pretenses;
- create or transmit unwanted electronic communications such as “spam” to other users or members of the ATMYNUMBER Site and/or ATMYNUMBER Service or otherwise interfere with other users’ or members’ enjoyment of the ATMYNUMBER Site and/or ATMYNUMBER Service;
- transmit any viruses, worms, defects, Trojan horses or other items of a destructive nature;
- use of the ATMYNUMBER Site or ATMYNUMBER Services to violate the security of any computer network, crack passwords or security encryption codes, transfer or store illegal material including that are deemed threatening or obscene;
- copy or store any information offered on the ATMYNUMBER Site for other than your own use;
- use any device, software or routine that interferes with the proper working of the ATMYNUMBER Site and/or ATMYNUMBER Service, or otherwise attempt to interfere with the proper working of the ATMYNUMBER Site and/or ATMYNUMBER Service;
- take any action that imposes, or may impose in our sole discretion, an unreasonable or disproportionately large load on our IT infrastructure;
- use the ATMYNUMBER Site and/ or ATMYNUMBER Service, intentionally or unintentionally, to violate any applicable local, state, national or international law;
- collect or store personal data about other users in connection with the prohibited activities described in this paragraph.
- If you are an international user, you agree to comply with all local laws regarding online conduct and acceptable content;
- attempt to impersonate another user or person; or
- sell or otherwise transfer your profile.

WARRANTY DISCLAIMERS
THE SERVICE, CONTENT, AND SITE ARE PROVIDED ON AN “AS IS” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
LIMITATION OF LIABILITY
IN NO EVENT SHALL ATMYNUMBER OR ITS SUPPLIERS BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE OR OTHER LEGAL THEORY (I) WITH RESPECT TO THE SITE, THE SERVICE OR ANY CONTENT FOR ANY LOST PROFITS OR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER, SUBSTITUTE GOODS OR SERVICES (HOWEVER ARISING), OR (II) FOR ANY DIRECT DAMAGES IN EXCESS OF (IN THE AGGREGATE) $100. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU.
TERMINATION
ATMYNUMBER may terminate or suspend any and all ATMYNUMBER Services and your ATMYNUMBER account immediately, without prior notice or liability, if you breach any of the terms or conditions of the Terms of Service. Upon termination of your account, your right to use the ATMYNUMBER Services will immediately cease. If you wish to terminate your ATMYNUMBER account, you may simply discontinue using the ATMYNUMBER Services. All provisions of the Terms of Service which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
